Uninsured & Underinsured Motorist (UM/UIM) Coverage in Nevada

The Uninsured Driver Problem

Despite Nevada’s mandatory auto insurance laws, a significant percentage of drivers on the road are uninsured. Others carry only the minimum required coverage, which may be far less than the cost of serious injuries. Nevada’s minimum liability requirements are:

  • $25,000 per person for bodily injury
  • $50,000 per accident for bodily injury
  • $20,000 for property damage

What Is UM/UIM Coverage?

Uninsured Motorist (UM) coverage pays for your damages when the at-fault driver has no insurance. Underinsured Motorist (UIM) coverage kicks in when the at-fault driver’s insurance is insufficient to cover your damages.

Nevada Law Requirements

Under NRS 687B.145, Nevada insurers must offer UM/UIM coverage to every policyholder. You must affirmatively reject it in writing if you don’t want it. If you were never offered UM/UIM coverage, you may still have it by operation of law.

Stacking

Nevada allows “stacking” of UM/UIM coverage in some circumstances — meaning you may be able to combine coverage limits from multiple vehicles on the same policy. An experienced attorney can review your policies to determine the maximum coverage available.

Filing a UM/UIM Claim

UM/UIM claims are filed with your own insurance company. Despite being your insurer, the company will still try to minimize the payout. An experienced attorney ensures that your own insurance company treats your claim fairly.
